California Supreme Court Denies Neighbor's For Smart Rail's Expo Line Petition

This just in...

The California Supreme Court says Expo Line Phase Two construction can proceed without any further study. The court affirmed the appeals court's Expo Line decision and denied Neighbors for Smart Rail's petition to have the line's environmental impacts restudied.

The majority of the court actually agreed with NFSR's first claim that the EIR failed to disclose the effects the project will have on existing environmental conditions. However, the court deemed this non-prejudicial to the case.

In a statement on their website, Neighbors for Smart Rail says their attorneys are are reviewing this unique opinion to understand what it means and does not mean.

Streetsblog LA covered the breaking news, with some history on this case, and quoted Expo Construction Authority CEO Rick Thorpe.

“We are gratified that the California Supreme Court has affirmed the lower court rulings," he said. “Today’s decision is a win for taxpayers and the future riders who will soon benefit from a direct connection between downtown Los Angeles and Santa Monica. We remain focused on finishing the Expo Line on time and on budget in 2015.”
